一般情况下，有专利任项专利行政部门提交相关证据，比如个人上半年月均收入低于¥3500，可以申请专利费用减免；企业上年度应纳所得税额低于¥300,000，可以减免专利费费用。
费用减缓条件个人申请：上年度月均收入低于5000元(年6万元)；企业申请：上年度企业应纳税所得额低于100万元；事业单位、社会团体、非营利性科研机构，直接申请费用减缓备案。注意事项：如果一件专利的申请人是两个或两个以上，不论是个人+个人/个人+企业/企业+企业等等情形，需要所有的共同申请人均符合费用减缓条件，申请的专利才能享受费用减缓。所需材料（1）个人有工作单位的，提交所在单位出具的年度收入证明+身份证复印件;无固定工作的，提交户籍所在地或者经常居住地县级民政部门或者乡镇人民政府(街道办事处)出具的收入证明;学生提交身份证复印件、在校证明(加盖学校公章)或学生证复印件。（2）企业一般企业：上年度纳税申报表（每页加盖公章及骑缝章）、最新的营业执照副本复印件加盖公章。事业单位、社会团体、非营利性科研机构：法人证明材料复印件，如法人证书。

2018年8月1号之后，专利授权10年之内都可以享受费减
专利的年费减免标准仅限于授权后六年内，一般提交完整的费减资料，只要符合费减条件就可以享受这一优惠，申请费用需要在提出申请之前备案申请，符合条件的就可以了，官方有文件出来说从2018年8月1日起，专利费减时间延长至10年，即专利的年费减免标准限于授权后10年内
专利有三种，分别是发明专利、实用新型专利、外观设计专利。根据专利类型的不同申请费用也会不同。发明专利：申请费用一共3450元，其中包括了900元的申请费用，50元的印刷费以及2500元的实质审查费用。实用新型专利：申请费用需要500元。外观设计专利：申请费用需要500元。
