Angela Carter (1940-1992) is an outstanding feminist writer whose influence on Britishwomen's writing was “pivotal in this opening and transformation” [“23]. 与其他文章相比，本文创新的之处是对农村信用社等金融机构消费信贷业务的风险管理问题和金融产品创新等方面进行了深入的阐述。

具体来说，我的论文是由母子公司法律关系的界定、母子公司法律关系的分析以及我国现行《公司法》关于“母子公司法律关系”的立法现状及改善思考和结束语四部分构成。

第一部分，在母子公司法律关系的界定上，以明确母子公司的法律概念为首要任务，在这一基础上进一步分析母子公司法律关系的概念及其特征，进而得出研究母子公司法律关系的现实意义，为全文写作奠定基础。

第二部分，对母子公司的法律关系分别从内部、外部进行分析，并重点探讨了特殊形态的母子公司—全资子公司与其母公司之间的法律关系，提出全资子公司应存在对其母公司担保方面权利本事的限制。

第三部分，以我国现行公司立法中关于母子公司法律关系的立法为出发点，采用比较分析的方法分析得出相关法律条文所存在的不够完善的地方，并提出立法改善的思考，同时，提出应存在对于子公司本身利益保护的观点。

第四部分，概括性的总结了母子公司之间的权利义务关系，指出加强和完善对这一问题立法的必要性。

整篇文章是我在查阅有关公司法权威学者著作的基础上，结合自身所学知识和个人的理解，最终在曲教师的指导和帮忙下完成的。在全文写作过程中构成以下新的理解与突破：

1.将全资子公司与其母公司的法律关系单独进行分析，打破以往对母子公司法律关系分析时只概括性指出其存在内外部法律关系这一局面，使全资子公司与其母公司之间的法律关系更加清晰化，从而增强相关法律的可操作性。

2.明确界定了母公司与子公司各自的法律概念，使得这一概念同诸如关联公司之类概念有了显著区别。

3.创设性的提出对子公司利益的保护还应存在从对其法定公积金的提取程序进行保护进而到达保护子公司合法权益的目的这一途径。
