专利与学术论文

简单来说,最大的区别就是专利的实用性比学术论文大多了,不仅可以用于高校自主招生、加创新学分、保研、出国、创业,而且还可以去申请专利资助补贴,花钱买论文,可能也就只能用那么一次,但专利不仅可以用多次,而且还可以去申请资助,花出去的钱又可以补回来,一方面是在给国家的创新和知识产权这一块做贡献,另一方面自己不仅多了一项优势和资本,而且如果专利申请得好,以后如果一不小心产品投放了市场,那多的都赚回来了哈

当然是先写专利。如果先写论文,论文发表了也就意味着这项技术成为现有技术,对于专利来说则丧失了新颖性和创造性,无法获得授权。

论文的格式要按审核要求的格式写。专利必须按照专利法和专利法实施细则的规定来写。两者的差别是非常大的。

1 论文是你要发表的文章。2 专利,是你向国家申请要保护的技术方案。3 简单的来说就是这样。

学术专利论文

对于科研员岗位,要求硕士在30周岁及以下,博士在32周岁及以下。此外,科研岗还要求在本专业相关SCI收录期刊上发表学术论文或有申请发明专利。在国家重点实验室等国家级创新平台有1年以上研究经历的优先。

开办的一款期刊文献检索东西,原从属于汤森路透(ThomsonReuters)公司[1]。被SCI收录的学术期刊称为SCI期刊,收录于SCI期刊的科技论文称为SCI论文。

我的建议是,您先说服您的公司就该发明申请专利,然后您再把您的实验成果写成学术论文发表。首先,申请专利与发表学术论文并不是相互矛盾的,但您得先将你的实验成向专利局提出专利申请,后发表学术论文,以免影响专利申请的新颖性。其次,专利法规定,专利实施后,企业要从实施专利所获得收益中分出一定比例作为职务发明的发明人的奖励,或一次性支付一定数额奖励。再者,关于学术论文发表的问题,我想您是担心该学术论文会被认定为职务作品,要知道是由于学术成果是您作出的,且学术论文是你完成的,该学术论文的署名权当然是作者本人!最后,提醒您一下,如果要对实验成果申请专利,请您尽快处理,因为您的产品已经生产,可能会造成使用公开,使你的专利申请丧失新颖性而不被授权。或则是即使授权也可能被无效掉!

论文和专利都属于技术文献.但实质有不同.论文是某一学术课题在实验性,理论性或观测性上具有新的科学研究成果或创新见解和知识的科学记录,或是某种已知原理应用于实际中取得新进展的科学总结,用以提供学术会议上宣读,交流或讨论;或在学术刊物上发表;或作其他用途的书面文件,从这个定义来看,论文有时候完全是纯理论的东西,而且对论文所要表达的内容并无太多限制,只要是新的研究成果即可,包括纯理论的,如数学公式、科学发现等。论文带给作者的很多时候只是荣誉以及著作权。专利明显不同,专利可保护的内容有限制,象数学公式、科学发现、外科手术方法、克隆技术等可以用论文形式发表的,都不能用专利来保护。这是内容的差别。还有法律意义上的差别,专利实际上是专利权的简称,它是国家或地区给与专利权人的一种排他权,除非专利权人允许,他人不得实施同样的专利技术,法律强制性很强,但是论文则完全没有这种法律约束,你发表了论文,却不能影响别人实施你论文的技术(当然,侵犯著作权则是另外的事)很多搞科研的人,很重视论文的发表,觉得那是体现学识优势的途径,但是不曾想,却也是免费教材。而且很多专家习惯先发表论文,然后再去考虑申请专利,却会因为论文的公开导致丧失新颖性。

本人顺利保研,就是利用的预推免的机会,下面说说预推免需要做的准备。

一、明确自己的保研资格

预推免是继夏令营之后保研人的一次很好的机会,它的时间一般是9月初开放报名(早的可能8月中下旬就开始报名了),预推免是比夏令营更容易进的,前提是这个时候你有保研资格了。

因为夏令营开始的比较早,学校不清楚你能否拿到保研资格的情况下,那么夏令营初筛肯定是要优中则优,而到预推免报名的时候,本校的保研资格会下发,这时候你告诉对方你已经有了保研资格,那么对方学校录用你的几率就高。

二、导师推荐信

这个一般是自愿提供的材料,有导师推荐信的话最好,不排除有些学校要求一定要两封正高级以上的推荐信,最好是提前准备。

同时报名时需要的材料也要准备好,如成绩单,院里盖章过的成绩证明,英语四六级证书、各类获奖证书,论文、专利、主持项目。

三、复习专业课梳理自己的科研项目

这无疑是最重要的,预推免不想夏令营还有其他活动,预推免一般就只有面试,需要考核你各方面的能力:英语水平、专业知识、是否具备基本科研素养。

1.一般老师还是非常看重基本的专业知识的,毕竟是基础,一定要复习好。

2.如果有已经做出成果的科研,一定要写论文!尽快能投稿最好,不能发表,但是参加预推免时手上有一篇完成度很高的论文也ok。我就是因为有一篇完成度更高的论文,导师直接收我了。

3.一定要整理自己的科研项目,梳理清楚,这样面试时才能有条不紊。

如果面试时老师问你做的科研相关的问题,而你答不上来,那么很有可能会给老师留下不认真的印象,很不好。

最后,祝你保研顺利,去到自己梦想的学校。

1、所保护的侧重点不同

论文是某一学术课题在实验性、理论性或观测性上具有新的科学研究成果或创新见解,或是某种已知原理应用于实际中取得新进展,这些论文的目的主要是用于在学术会议上宣读、交流或讨论,或者在学术刊物予以发表,也有一些形成项目文件作为项目申报或者答辩的依据。

从这个角度来看,论文有时候完全是纯理论的东西,如一些数学公式、算法推理等等,同时,对于论文所要表达的内容并无太多限制。论文带给作者的很多时候只是荣誉以及著作权。

专利明显不同,专利可保护的内容有限制,象数学公式、科学发现、外科手术方法、克隆技术等可以用论文形式发表的,都不能用专利来保护。这些在专利法中被归结为智力活动或者治疗方法,不属于专利法保护范畴。

申请专利的重点在于知识产权保护,发表科研论文的目的在于知识传播和分享。

2、撰写方式不同

专利申请书的第一部分为背景技术介绍,要求申请人对背景技术及其不足之处进行描述和总结。论文或者项目的第一步部分和发明专利申请书很类似,也是介绍前人的研究工作及不足之处。不同之处在于论文必须引用和列出相应的参考文献,而专利申请则可以不列参考文献。

专利申请书的第二部分为技术方案。这部分和论文的方法比较类似,但不同之处居多。这部分内容中,要求申请人用文字和公式阐述发明的技术方案,而不能用图表。即使发明的技术方案用图表更容易说明问题,发明人也必须把图表内容转换成文字。

尤其是涉及到复杂装置的技术方案,用文字表述需要特殊技巧。论文的方法部分则没有多少限制,论文撰写人可以选择更容易让读者理解和明白的论文撰写方式,可以有详细的公式推导和图表,甚至可以直接插入实验器材照片,而这些在专利申请文本中是不允许的。

3、审查不同

从审查角度,专利由专利审查人审查,重点判断发明的技术方案和现有文献有无重复之处,专利检索新颖性是是否能获得授权的重要一环,专利审查员往往会从专利库、论文库以及国际专利库、论文库中进行国际性检索。

而科研论文由同行审稿,重点判断实验数据是否可靠,结论是否准确。由于专利审查员一般不是同行,发明的技术效果无法通过专利审查保证。
